These Terms and Conditions ("Terms") govern your use of the Benja Legal website at benjalegax.biz and the legal services provided by Benja Legal ("the Firm," "we," "us," "our"), operating from 17 Sathorn Road, Sathorn, Bangkok 10120, Thailand. Please read these Terms carefully. By using our website or engaging our services, you confirm that you accept these Terms and will comply with them.
1. Definitions
- "Agreement" means these Terms and Conditions together with any engagement letter or service agreement entered into between you and the Firm.
- "Service" refers to legal advice and representation services provided by Benja Legal, including Initial Pension Consultation, Claim Preparation & Negotiation, and Full Pension Defence Engagement.
- "User" / "you" refers to any person visiting our website or engaging our services.
- "Content" means all text, documents, materials, and information published on or made available through our website.
2. Acceptance of Terms
By accessing our website or submitting an enquiry, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement under Thai law. If you are acting on behalf of another person, you confirm that you have authority to do so and that the represented person also meets the age requirement.
3. Service Description
Benja Legal provides legal advisory and representation services in connection with pension matters in Thailand. Services are available to individuals residing in or with pension interests within Thailand. The Firm operates primarily from Bangkok but provides consultations by phone and video call to clients in other locations.
All legal services are provided by practitioners registered with the Lawyers Council of Thailand. Nothing on our website constitutes legal advice; advice is provided only within the context of a formal engagement.
4. User Responsibilities
When using our website or engaging with the Firm, you agree to:
- Provide accurate, complete, and current information
- Not use the website for any unlawful purpose or in a way that violates applicable Thai law
- Not attempt to gain unauthorised access to any part of the website
- Not transmit any content that is false, misleading, harmful, or defamatory
- Cooperate fully and honestly in providing information relevant to your legal matter

6. Payment Terms
Service fees are as published on our website and confirmed in the engagement letter prior to commencement of any work:
- Initial Pension Consultation: ฿4,700
- Claim Preparation & Negotiation: ฿9,200
- Full Pension Defence Engagement: ฿18,000
All fees are stated in Thai Baht (THB) inclusive of applicable VAT where required. Payment methods accepted are bank transfer and major credit/debit cards. Fees are due as specified in the engagement letter. Work will not commence prior to receipt of the agreed fee unless otherwise stated in writing.
Refund Policy
Fees for completed consultation sessions are non-refundable. For claim preparation and defence engagements, fees paid in advance may be partially refunded in proportion to work not yet commenced, calculated at the Firm's standard rate, where the client withdraws in writing before the relevant stage begins. The Firm reserves the right to retain fees for documented preparatory work in all cases.
7. Service Delivery Terms
- The scope of each engagement is confirmed in a written engagement letter before work commences
- Timelines provided are estimates; the Firm is not liable for delays attributable to third parties, pension authorities, or circumstances outside its control
- Changes to scope requested by the client during an engagement will be discussed and, where agreed, reflected in a written amendment
- The Firm will maintain professional confidentiality throughout the engagement and after its conclusion
8. Disclaimers
The website and its content are provided for general information purposes only. Website content does not constitute legal advice and should not be relied upon as such. The outcome of any legal matter depends on specific facts and circumstances; the Firm makes no representation as to the probable result of any matter it is engaged to handle.
9. Limitation of Liability
To the extent permitted by Thai law, the Firm's liability for any claim arising from the provision of services is limited to the fees paid by the client for the relevant engagement. The Firm is not liable for any indirect, incidental, or consequential loss. Nothing in these Terms limits liability for fraud, wilful misconduct, or any liability that cannot be excluded by law.
10. Indemnification
You agree to indemnify and hold Benja Legal harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms or from information you have provided that proves to be false, incomplete, or misleading.
11. Termination
Either party may terminate an engagement by written notice. The Firm may terminate an engagement immediately where a client provides materially false information or where professional obligations require withdrawal. Upon termination, fees for work completed remain due. Sections relating to intellectual property, liability, and dispute resolution survive termination.
12. Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Thailand. In the event of a dispute, the parties agree to first attempt resolution through informal negotiation. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the Thai courts, with the Bangkok courts having primary jurisdiction.
13. General Provisions
- Entire agreement: These Terms, together with any engagement letter, constitute the entire agreement between the parties regarding the subject matter hereof.
- Severability: If any provision is found unenforceable, the remaining provisions continue in full force.
- Waiver: Failure to enforce any provision does not constitute a waiver of future enforcement rights.
- Assignment: You may not assign your rights under these Terms without written consent. The Firm may assign its rights in connection with any reorganisation or transfer of business.
14. Changes to These Terms
We may update these Terms from time to time. The revised version will be posted on this page with a new "Last Updated" date. Continued use of the website or services after the effective date constitutes acceptance of the updated Terms.
